Deborah J. Krabbendam focuses her litigation practice on complex commercial litigation, including contracts, securities litigation, and insurance matters. She provides long-range planning, research, and writing support in the litigation and appeal of complex commercial matters, including breach of contract claims, class actions, securities claims, and employment discrimination claims.
Representative Matters include the following:
- Represents former officers in cases relating to the bankruptcy of subprime lenders, including securities class actions in federal district court in Pennsylvania and related state court actions.
- Represented insurer in nationwide consumer class action alleging abusive practices in the sale of universal life policies; defeated class certification and obtained summary judgment in the client's favor.
- Represented insurer in nationwide consumer class action alleging misrepresentations in the sale of universal life insurance policies; defeated class certification.
- Represented insurer in nationwide consumer class action in claims arising from alleged omissions and misrepresentations in the sale of and subsequent rate increases in long-term care policies sold in the mid-1980s.
- Represented three different insurers in nationwide consumer class actions alleging inadequate disclosures or omissions relating to modal or fractional premium charges; secured dismissal of one case on forum non conveniens grounds; secured the named plaintiff’s voluntary dismissal of a second case after initial motion practice; the third case is still pending.
- Represented insurer in nationwide consumer class action involving a variable universal life insurance product and alleged inadequate disclosures regarding premium tax charges; achieved dismissal of the case, which was affirmed on appeal.
