Biography
Mark Seiberling currently practices in the areas of complex commercial litigation, class actions, professional liability and white collar defense.
Representative matters include the following:
- Obtained a defense verdict in malicious prosecution action brought against Fortune 500 company and its outside attorneys
- Successfully represented legislative body in pursuit of legislatively privileged materials illegally seized by executive branch investigators
- Successfully represented legislative body in Right-to-Know appeal involving attorney-client privileged and grand jury materials
- Represented approximately 60 current and former employees of the House Democratic Caucus in the grand jury and at trial in connection with the Pennsylvania Attorney General's Bonusgate investigation
- Represented the Senate Republican Caucus in connection with the Pennsylvania Attorney General's Bonusgate investigation
- Represented multiple charter schools involved in various federal grand jury investigations
- Won summary judgment and subsequent appeal of complex litigation involving a school district’s attempt to impose student enrollment limits at charter schools in district
- Obtained dismissal and subsequent affirmance of dismissal on appeal of Section 1983 civil rights action brought against state legislator
- Obtained dismissal and subsequent affirmance of dismissal on appeal of class action involving massage therapists who sought reimbursement from insurer for their unlicensed treatment of therapeutic massage
- Successfully defended county government and its employees in Section 1983 civil rights and wrongful discharge action brought by former employee
- Represented national supermarket chain in administrative appeal to Pennsylvania Department of Health
- Won motion to dismiss fraud and breach of fiduciary action brought by insured against former insurance broker
- Won dismissal of fraud, breach of contract and conspiracy action brought against prominent insurer
- Conducted internal investigations of various entities accused of fraud and misappropriating funds
In addition to his clerkship with Justice Newman, Mark also served as a judicial intern to The Honorable Dolores K. Sloviter of the United States Court of Appeals for the Third Circuit and The Honorable John J. T. Kelly, Jr., of the Pennsylvania Superior Court.
