Conrad O'Brien Wins Summary Judgment for Pennsylvania-American Water Company

Conrad O’Brien attorneys Frank R. Emmerich Jr., Daryl W. Winston and Colleen M. Johns successfully pursued summary judgment for their client, the Pennsylvania-American Water Company. In 2001, an industrial complex was destroyed by a fire which burned over the course of two days and involved over 90 fire companies to respond to the fire. A class action was instituted on behalf of a class of plaintiffs primarily consisting of tenants who occupied the complex. The owner of the complex also brought claims against the Water Company. It was contended that the Water Company failed to supply sufficient water pressure and flow to fire hydrants to fight the fire resulting in the complete destruction of the majority of the complex. Through extensive discovery, the original damage claim of $100 million was reduced to $64 million. Despite 109 depositions in the case and the production of hundreds of thousands of documents, Conrad O’Brien was able to demonstrate that there was insufficient evidence to allow the claims to proceed against the Water Company.
